Terms and conditions of use and shipping information

Hitex SA delivers its products worldwide.

1. About Terms and Conditions

In these terms the terms “we” and “our” refer to Hitex SA and the term “you” refers to the customer.

2. Acceptance of Terms

The customer acknowledges having read, at the time of ordering, the conditions stated on this screen and expressly accepts them without reservation.
These Terms of Use govern the contractual relationship between Hitex SA and the client, both parties accepting them without reservations.

3. Products The images and / or photographs of the products offered on www.www.mydecanto.ch are not contractual. If errors happened, in no event shall Hitex SA will be held liable. It may be that by including the color settings made, the colors of the products may differ from actual products. Technical information and links are for informational purposes only. Technical specifications and / or content of the delivered products may also differ with respect to the data provided or displayed on the site www.mydecanto.ch

4. Prices All prices are in Swiss Francs. Prices do not include transportation costs. The price charged to the customer is the price indicated on the order confirmation, which appears with transportation costs. The prices listed on the order confirmation are binding even in the event of variation between the order date and the date of delivery of the goods. If there was a pricing error on a product, Hitex SA reserves the right to change the price by offering the customer a choice to cancel the order if the new price does not suit him.

Swiss VAT 8% is included in our prices when pricing is in “Swiss Francs”. For shipments abroad, deliveries are based on pricing in “Swiss Franc (HT)”, i.e. without the Swiss VAT (8%). The pricing in “Euro (VAT)” is only given as an indication. In case of deliveries abroad we do not charge VAT, but if the package is checked by customs you will have to pay VAT of your country (country where the package is delivered) and eventually customs, if applicable.

5. Order

A firm order is passed when the customer presses the button “Confirm Order” on the confirmation page. By placing an order, you make an offer to purchase the products you have selected. We reserve the right to accept or reject your offer at our discretion. Hitex SA confirms to the customer the acceptance of the order and its status with an e-mail to the e-mail address that it is provided when registering on the website. This confirmation is effective when the customer receives an e-mail from Hitex SA indicating that the order is placed in “In Process.” This e-mail forms a sales contract between you and Hitex SA. Hitex SA reserves the right to cancel any order from a customer with whom there is a dispute over payment of a previous order. In case of error in the recipient’s details, Hitex SA can not be held responsible for delivery caused by erroneous delivery address.

By ordering, you certify being aged 18 years or older.

6. Shipping

Variable delivery fee is applied. The amount of shipping (packaging, shipping and handling) is determined according to the total amount, weight and destination of your order.

7. Delivery

For stock items, Hitex SA ensures delivery within 24 to 48 hours. If the equipment is not in stock at the time of the order, the delay is determined by the availability of the product from our factory. However, this information is indicative only and not guaranteed. You, the Client, may at any time request by e-mail an estimate of the delivery time of your order.

If out of stock, no compensation or penalties for late delivery may be requested.

When out of stock, delivery time is 15 days.

Our delivery times are indicative. Hitex SA cannot be held responsible for late delivery.

Please note that for deliveries outside Switzerland, the period may be longer (5-10 days) due to the customs clearance and transportation.

8. Payment methods

For private and corporate customers Hitex SA offers several methods of payment:

Credit cards

The simple and completely secure to make purchases using a credit card Mastercard or VISA. Transactions are secured and processed by SIX Payment systems. The amount is debited on the day of dispatch of the order.

PostFinance (PostFinance Card or E-Finance) – Switzerland only

PostFinance, you can pay comfortably, safely and free on the Internet. The amount is debited directly from your account on the day of postal dispatch of the order.

Pre-payment

The most advantageous because it allows you to enjoy 2% discount on your order! When you choose this method of payment you will automatically receive 2% off your entire order). The amount is automatically calculated on the order confirmation online, then you just pay the full amount of your order on our account (CCP) No.17-49-3, order Hitex SA, Route d’Amont 14, 1720 Corminboeuf, Switzerland.

Thank you to facilitate the processing of your order to indicate your order number in the comments of payment (e.g. order No.123456). If you wish to expedite the processing of your order, you can send us proof of payment via e-mail.

9. Retention of ownership

Hitex SA retains ownership of all goods delivered until full payment of the invoice relating thereto.

10. Damage, errors and problems during delivery

Any damage in transportation (e.g. damaged package) must be reported immediately to the carrier at the time of delivery. Failure to do so, the customer shall bear all the responsibility for damaged goods.

All goods delivered by mistake or in excess must be returned immediately, or at the latest within 7 days. In case of no return, the goods will be invoiced.

Our packages are sent against signature for all orders with a value greater than CHF 150.00. Hitex SA does not assume any loss or theft of a parcel sent without signature. It is the customer’s responsibility to ensure that the mailbox is secure or to inform his office not to deliver the parcel during his absence.

11. Return period

Hitex SA grants a withdrawal period of 7 working days from the date of delivery of the products (product arrival at destination – according to this postal tracking even if the package is not claimed at the Post or by the carrier) and agrees to take them back, provided that they are not damaged or opened and are still in their original packaging.

After 7 days all sales are final.

12. Warranty or return

Upon receipt of the order, you are required to verify the content and condition of the goods. If you find an anomaly, refuse the package and notify us by e-mail stating the invoice number and the defective product. For any return in connection with a delivery error, a defective product, etc.. a request for return is mandatory. All requests for returns must be made by e-mail. We shall provide you the steps to follow.

13. Our responsibility

These “Terms and Conditions” determine all of our obligations and responsibilities.

We are not bound by any other warranty, condition or other provision except those expressly stated in this contract.

Any warranty, obligation or other provision concerning the products or services that may be implied or incorporated into this Agreement by law, case law or otherwise (including without limitation any implied condition as to the quality, suitability for purpose of any and all due diligence) are expressly excluded by this provision. In particular, Hitex SA does not undertake to guarantee that the products are suitable for the purpose for which they are intended.

Our liability under this contract shall be commenced or used for any loss of income, loss of profits, loss of contracts, loss of data or for any indirect loss or damage or consequential damages of any nature whatsoever resulting from or caused by tort (including negligence), breach of contract or otherwise. Our total liability for any breach of contract or otherwise (including negligence) or any other cause shall in no case exceed the amount that you are liable for the goods or services in question.

We can not be held responsible for any loss or damage you may suffer and our result from delay in performance of any of our obligations or our breach of any or all of our obligations under the contract, since that such delay or failure is due to circumstances outside our control. In case of delay, we will perform our obligations as soon as possible.

Hitex SA can not be held liable for damages of any kind, whether tangible or intangible, which could result from a malfunction or improper use of products sold. Responsibility of Hitex SA will, in any event, will be limited to the amount of the order and can not be blamed for simple errors or omissions that may occur despite all precautions taken in the presentation of products.

14. Privacy Hitex SA undertakes to comply with the provisions of the Federal Law on Data Protection. All personal data provided by the customer are treated confidentially and will not be sold to any third parties. The customer can modify his personal data at any time or to require their deletion.

15. Trademarks

My DeCanto is the name brand of the company Hitex SA.

16. Disputes

This contract is subject to Swiss law. In case of dispute, Hitex SA reserves the choice of the court.

17. Other cases

For all other cases not covered in these conditions of sale apply Code of Obligations.

All our prices for deliveries within Switzerland include VAT (8%), excl. shipping.
